Under normal circumstance, a country doesn't usually opt for ICJ route to deal with water disputes because it's too rigid and procedural using various instruments such as scientific data and maritime legal history, that ends up eliminating possible informal leveraging options, like possible bilateral negotiations not confined to international rules. Kenya became too arrogant, not even knowing the weakness of their claim, now conclusively chained by the international court.
