This is a fair ruling tho. How can u take into account the testimony of a drunk person? If you were raped, the moment the guy who raped you leaves, u need to go to the doctor and collect evidence ASAP. If you are passed OUT, then this is a personal negligence of your own body.

Eh, got two opinions on this.
On one hand, the supposed victim who's intoxicated may be a drunkard who's just fulfilling his/her sexual fantasies unconsciously, and therefore cannot be declared a 'victim', since he/she (though involuntarily) consented to sexual intercourse.
On the other hand, the victim may actually be forced into intercourse while in a state of vulnerability (ie, Intoxication). And there are many cases of this occurring. For instance, after parties (be it high school, college, etc), men would actually take women who are heavily intoxicated, and forcefully engage in intercourse with them. Although one can argue that it's the woman's fault for not taking the precautions before before consuming an intoxicating beverage, we still must hold the men who are responsible for taking advantage of women in that state to accountability.

This is pretty fucked up. If people go to a bar, they're going to get drunk. This basically means the rapist is not liable if he or she rapes a drunk person.

I'm not naive, the odds are that most rapes are done by men, not by women. But it is possible. Generally the motive is to force impregnation to trap the man, most likely due to his wealth.
You can believe what you want to believe. I'm not here to convince you of anything. Look it up yourself.

I am saying, a man cannot have sex without his permission. The mechanics of a man to have an erect penis, and therefore have sex is-- the man has to be turned on. He sends signals through nerves from his brain to his penis. If his brain is numb from alcohol, how can it send signals for blood to go to the penis? defeats the purpose ma ha?
