That's drunk sex. You do realise that before sex people talk to each other and during sex both parties communicate. You'll know when it's rape because you're crossing a natural drawn line. Rape is a decision.

Well it depends if either party were so drunk that they could not reasonably consent to any part of the sexual encounter, then the other could be charged with, and found guilty of rape
Look the law states that consent can only be given when of clear and sound mind. She can say yes all she wants but she is not in the proper state of mind to consent knowingly case closed!

I dont know what youre on about but this does happen and in cases were both are drunk unless she files a police charge they start an investigation and act accordingly

Wow, the answer is so simple yet everyone is making this harder than it should be. Forcing someone to do something against their will is a BAD thing..... don't they teach you that in preschool? Men and women get raped and it's still ongoing, happening at this day and age. There are reasons and statistics out there (if you even care to read or have been in a psychology class...) that rape is an abuse of power, a rapist is someone who knows they can take an advantage of someone and KNOWS they can get away from it, and the rapist is usually someone who the victim is very familiar with like a family member and or community members - It's a serious topic and you guys are making this into a joke.... I'm horrified. It can happen to anyone and people you may know are abusing their powers on others. There are bad people in the world but they know how to mask that part of themselves. Just have an open-mind. Trying to prevent rape by pointing at the victim isn't going to stop rape from happening, looking at the people who are DOING this to others will prevent it from happening.
